The Short Version: We collect your information to help you get health insurance. We don't sell it to random companies or use it for anything sketchy. We're licensed professionals who take privacy seriously because, frankly, dealing with privacy violations is more paperwork than anyone wants.
1. Who We Are
Lakeland Health Insurance is a licensed independent insurance agency operated by David Huff (FL License #W371813) through HealthMarkets. We are not a government agency. We are not the Health Insurance Marketplace. We are independent, licensed insurance professionals.
We help individuals, families, and small businesses find coverage through:
- ACA / Health Insurance Marketplace plans
- Medicare Advantage, Part D, and Medicare Supplement plans
- Health Protector Guard (HPG) and fixed indemnity plans
- Dental, vision, life, and other ancillary insurance products
This policy applies to all information collected through our website, phone calls, text messages, emails, in-person meetings, and third-party platforms. It covers residents across the United States, with a primary focus on Florida.
2. Medicare & TPMO Disclosures
Important Medicare Notice: We do not offer every plan available in your area. Currently we represent multiple organizations which offer various products in your area. Please contact Medicare.gov, 1-800-MEDICARE (1-800-633-4227), or your local State Health Insurance Assistance Program (SHIP) to get information on all of your options.
As a Third-Party Marketing Organization (TPMO), we want you to know:
- We are compensated by insurance carriers when you enroll in a plan through us. This compensation does not increase your premium or cost.
- Providing your personal information is voluntary. We will never require you to agree to have your data sold or shared with other TPMOs as a condition of receiving insurance information or services.
- A Scope of Appointment (SOA) form is required at least 48 hours before any scheduled Medicare sales appointment, as mandated by CMS.
Medicare Call Recording
All telephone calls regarding Medicare Advantage and Medicare Part D prescription drug plans — including marketing, sales, and enrollment discussions — are recorded as required by the Centers for Medicare & Medicaid Services (CMS) under 42 CFR 422.2274 and 423.2274. This is a federal requirement and cannot be opted out of. Recordings are stored securely for a minimum of 10 years.

A. Information You Provide Directly
When you request a quote, contact us, or apply for coverage, we may collect:
- Name, address, email, and phone number
- Date of birth, gender, and household size
- Income and tax filing status (for ACA subsidy calculations)
- Health information such as current medications, medical conditions, and doctors (for plan comparison)
- Current insurance information (carrier, policy numbers, Medicare ID)
- Social Security number (only when required for enrollment)
B. Information Collected Automatically
When you visit our website, we automatically collect:
- IP address and approximate geographic location
- Browser type, device identifiers, and operating system
- Pages visited, time on site, and referring URL
- Data collected through Google Analytics (GA4) — including session data, traffic sources, and user interactions
- Data collected through Meta Pixel (Facebook Pixel) — including page views, form submissions, and conversion events
C. Information from Third Parties
We may receive information from:
- Insurance carrier partners (eligibility data, enrollment confirmations)
- CMS and Healthcare.gov (for ACA and Medicare enrollment verification)
- HealthMarkets (our field marketing organization)
D. Sensitive Information
Some of the information we collect qualifies as sensitive, including health information, financial data, and Social Security numbers. We collect sensitive information only when it is necessary to provide the insurance services you have requested.
4. How We Use Your Information
We use your information for these specific purposes:
- Providing health insurance quotes and plan comparisons
- Processing applications and facilitating enrollment with insurance carriers
- Communicating about your policy status, renewals, and coverage changes
- Verifying identity and eligibility (ACA subsidy verification, Medicare eligibility)
- Responding to your inquiries and providing customer service
- Complying with legal obligations (CMS reporting, state insurance department requirements, GLBA)
- Improving our website functionality and user experience through analytics
- Marketing additional insurance products to you (only with your consent)
5. How We Share Your Information
Insurance Carriers
We share your personal and health information with insurance carriers — including ACA issuers, Medicare Advantage organizations, Part D plan sponsors, and supplemental insurers — solely to obtain quotes, process applications, and service your policies.
HealthMarkets
As our field marketing organization (FMO), HealthMarkets receives certain data for commissions processing, compliance oversight, and carrier appointment management.
Service Providers
We use third-party service providers who are contractually bound to use your data only for the purposes we specify:
- Website hosting and analytics (Google, Meta)
- Customer relationship management (CRM) systems
- Email and communication platforms
- Call recording and phone systems
- Scheduling tools (Calendly)
Government Agencies
We share information with CMS, Healthcare.gov, state insurance departments, and law enforcement when required by law or valid legal process.
What We Do NOT Do
We do not sell your personal information to marketers, data brokers, or anyone else. We do not share your Medicare beneficiary data with other TPMOs without your prior express written consent. We do not condition access to insurance information on you agreeing to have your data sold or shared. Life's too short for that nonsense.
6. Phone, Text & Email Communications
Phone Calls
By providing your phone number, you consent to receive calls from Lakeland Health Insurance regarding insurance products and services. Consent to be contacted is not a condition of purchasing any insurance product. You may revoke consent at any time by calling us, emailing us, or requesting removal.
Medicare Calls
All Medicare Advantage and Part D calls (marketing, sales, and enrollment) are recorded as required by federal law (42 CFR 422.2274 and 423.2274). Recordings are retained for a minimum of 10 years. This requirement cannot be opted out of.
Florida Recording Law
Florida is a two-party consent state for call recording (Florida Statute 934.03). We disclose at the start of calls that the call may be recorded. This applies to all calls, not just Medicare calls. If you are in another two-party consent state (such as California or Illinois), the same disclosure applies.
Text / SMS Messages
If you opt in to receive text messages from us:
- You will receive messages regarding insurance quotes, policy information, and appointment reminders
- Message frequency varies
- Message and data rates may apply
- Reply STOP to opt out at any time
- Reply HELP for assistance
Consent to receive text messages is not a condition of purchasing any insurance product. We maintain records of text message consent including date, time, and method.
All marketing emails include an unsubscribe link, our physical address, and sender identification as required by the CAN-SPAM Act. You may opt out of marketing emails at any time. Transactional emails about your existing policies or enrollment are not marketing and will continue as needed.
7. Cookies & Tracking Technologies
Our website uses the following tracking technologies:
Google Analytics (GA4)
Collects: pages visited, session duration, traffic sources, device information, and approximate location. This data helps us understand how visitors use our website. You can opt out using the Google Analytics Opt-Out Browser Add-On.
Meta Pixel (Facebook Pixel)
Collects: page views, actions taken on the site (form submissions, button clicks), and conversion events. This data is shared with Meta for ad targeting and audience building. You can manage your ad preferences at Facebook Ad Preferences.

8. Data Security
We take the security of your information seriously. Our safeguards include:

- Administrative safeguards: Access controls limiting who can view your information, privacy and security training, and regular security reviews
- Physical safeguards: Secure storage of any paper records containing personal information
No system is 100% secure, but we're not amateurs either. In the event of a data breach affecting your personal information, we will notify you as required by law, including within 30 days as required by the Florida Information Protection Act (FIPA) for Florida residents.
9. Data Retention
We retain your information only as long as necessary for the purposes described in this policy or as required by law:
- Medicare call recordings: 10 years (CMS requirement)
- Scope of Appointment forms: 10 years (CMS requirement)
- TPMO consent records: 10 years (CMS requirement)
- Enrollment and policy records: As required by carrier contracts and state insurance regulations (typically 7-10 years)
- Communication consent records (TCPA): Duration of the business relationship plus 4 years
- Prospect and lead data: Up to 24 months for unconverted inquiries, or until you request deletion
- Website analytics data: Per Google Analytics and Meta default retention settings (14-26 months)
10. Your Rights
All Consumers
Regardless of where you live, you have the right to:
- Request access to the personal information we hold about you
- Request correction of inaccurate information
- Opt out of marketing communications (calls, texts, and emails)
- Be placed on our internal do-not-call list (honored within 30 days)
- Opt out of sharing of nonpublic personal financial information with nonaffiliated third parties (under the Gramm-Leach-Bliley Act)
State Privacy Law Rights

We will verify your identity before processing any request. We respond to privacy requests within 45 days as required by applicable law. If we cannot fulfill your request, we will explain why and inform you of your right to appeal.
11. Children's Privacy
Our website and services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected a child's information, please contact us immediately so we can delete it.
12. Third-Party Links & Services
Our website contains links to third-party websites including insurance carrier sites, Healthcare.gov, Medicare.gov, and SHIP programs. We also use third-party tools like Calendly for scheduling. These services have their own privacy practices and policies. We encourage you to review them before submitting your information. We are not responsible for the privacy practices of any third-party website or service.
13. Changes to This Policy
We may update this privacy policy periodically to reflect changes in our practices or legal requirements. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we may also notify you by email. Continued use of our services after changes are posted constitutes acceptance of the updated policy.
